The bid of a Beverly Hills man to postpone his imminent Manhattan trial or to have his case severed from his codefendants because his wife of 26 years—the mother of his seven children—is dying of cancer has been rejected by a federal judge.

In an order issued Thursday, Southern District Judge Victor Marrero, while expressing his “heartfelt sympathy” to the family of David Rubin, said “Mrs. Rubin’s deteriorating health cannot delay this trial.”
