ALBANY – A public school district is not obligated to provide free education to children who have come from across New York and the country to live in a local residential child-care institution operated by the Greek Orthodox Archdiocese, the state Court of Appeals ruled yesterday.
The judges decided unanimously that the fact that the St. Basil Academy in Garrison was granted status as a residential child-care institution in November 2006 by the Office of Children and Family Services does not change the basic rule that school districts are only required to provide tuition-free education to children who are bona fide residents of the districts.
