A judge on Long Island has refused to block a 19-year-old woman from accessing a jury award, despite concerns from her parents that their daughter, convicted of narcotics trafficking, could misuse the funds.
“While this Court can appreciate a parent’s desire to have funds set aside for a child utilized properly (hence, structured settlements and spendthrift provisions in testamentary documents), unless there is some reason to appoint a Guardian, a competent adult is free to use his or her funds as desired—foolishly, capriciously, impulsively or otherwise,” Nassau County Justice Joel K. Asarch (See Profile) wrote in Alyssa H. v. Robinson’s Ambulance & Oxygen Services Inc., 15267-2000.
