Matter of Application of Frances Cinicola As Limited Administrator of The Estate of Julia O’connell, deceased, To Discover And Turn Over Property Withheld.

In this discovery proceeding pursuant to SCPA § 2103, respondents Richard Menna and Charles Baron were ordered to show cause why they should not appear for an inquiry and be examined regarding the validity of transfers of decedent’s real property interests as set forth in the petition, and to turn over to the petitioner as limited administrator documents in their possession relating to said transfers; why Richard Menna should not be ordered to turn over to the petitioner all banking and tax records of the decedent as well as statements of rents and interest collected and disbursements made by him as Trustee of the decedent’s alleged inter vivos trust and to turn over to the petitioner deeds to five parcels of real property previously owned by the decedent and now owned by him as such Trustee; and why the deeds to the decedent’s five parcels of real property now in the name of respondent Richard Menna as Trustee should not be set aside and deemed null and void.
