MATTER OF SARAH B. — The petitioner, Little Flower Children’s Services, a child protection agency, moves1 pursuant to Family Court Act §1039-b (b)(6) for an order that reasonable efforts to return the child Sarah to the home of the respondent parents are no longer required, as not in the child’s best interests and contrary to the health and safety of the child, and for a finding that such efforts would not likely result in reunification of the parents with Sarah in the foreseeable future. The petitioner relies on an order of disposition [B 1719- 21/96] entered on January 8, 2001, granting custody and guardianship of three of Sarah’s siblings to the Commissioner of the Administration for Children’s Services for the purpose of consenting to their adoption. The basis for the order as to the mother was mental illness [SSL §384-b (4)(c)] and as to the father was permanent neglect [SSL §384-b (7)(a)]. This order, entered after fact-finding before another judge of this court, was affirmed on appeal. The law guardian, in support of petitioner’s motion, relies in addition upon orders [B 3194-6/94] terminating the respondents’ parental rights as to three older children, entered on December 2, 1997, also affirmed on appeal.
