CONNELL v. THE GUARDIAN LIFE INSURANCE CO. Plaintiff, Joseph Connell, brings this action under the Employee Retirement Income Security Act of 1974, 29 U.S.C. §1001 et seq, alleging that he was denied benefits under Guardians Severance Plan. Currently before the Court is Defendants motion to dismiss the complaint on the grounds that Plaintiffs request for severance benefits was untimely or, alternatively, that the Plan Administrators decision was not arbitrary and capricious.
