HASLAHA, INC. v. JUBILEE, INC. — During the bench trial of this commercial landlord-tenant holdover proceeding the Respondent offered into evidence photographs allegedly depicting the commercial premises at the time the Respondent took possession. To authenticate these photographs, Respondent called as a witness the immediately preceding tenant who transferred possession to the Respondent and who continued to work at the premises for nearly two months during the transitional period. This witness testified that the photographs truly and accurately depicted the premises as they existed during the entire period of his tenancy and at the time of the transfer of possession. The presumed purpose for the proffer of these pictures was to indicate the existence of a particular door.
