2328 UNIAVE CORP. v. BRUNILDA BEHELER — Petitioner commenced the underlying summary holdover proceeding in or about September 2002. The petition states that the premises are subject to the Rent Stabilization Law and annexed to the petition and incorporated therein are the Ten Day Notice to Cure and the Ten Day Notice To Terminate. The Notice to Cure Illegal Sublet states: “Please Take Notice That you are hereby Advised to Cure the substantial breach of a material clause of your lease agreement wherein it is alleged that you sold, assigned, underlet or sublet your above referenced apartment to another party without the permission of the landlord, and without abiding by the applicable statutory authority law. SPECIFICALLY: YOU ARE ILLEGALLY SUBLETTING AND RENTING ROOMS WITHIN YOUR APARTMENT WITHOUT PERMISSION OF THE LANDLORD.” Respondent appeared by counsel and interposed an Answer.
