CAMPOS v. BARNHART — Maria Campos (“Plaintiff” or “Campos”) brings this action on behalf of her minor child Mario Cruz pursuant to 42 U.S.C. §405(g). Plaintiff seeks judicial review of a final decision by the Commissioner of the Social Security Administration (the “Commissioner”) denying her son’s claim for supplemental security income (“SSI”) benefits based on disability under Title XVI of the Social Security Act. See 42 U.S.C. §§1381-85. Plaintiff has moved for judgment on the pleadings and, in the alternative, seeks reversal of the Commissioner’s decision and a remand for further administrative proceedings. The Commissioner opposes Plaintiff’s motion for judgment on the pleadings but supports the motion for an order reversing the Commissioner’s decision and remanding the case for further administrative proceedings. For the reasons set forth below, the decision of the Commissioner is reversed and the case is remanded solely for the calculation of benefits.
