PEOPLE v. ANTHONY ROSS This court ruled, at the conclusion of a hearing on defendants motion to suppress statements, that the oral statement made by defendant had to be suppressed as the product of custodial interrogation conducted without benefit of Miranda warnings. Decision was reserved as to the admissibility of defendants subsequent written statement, obtained by the police after full Miranda warnings were given. The remaining issue is whether the written statement was tainted by defendants earlier, inadmissible statement or whether there was a sufficient break between the two statements to constitute attenuation and, thus, render the written statement admissible.
