FORBES v. STATE UNIVERSITY OF NEW YORK — The pro se plaintiff Semone Forbes (“Forbes” or the “plaintiff”) alleges that the defendant the State University of New York at Stony Brook (“SUNY” or the “defendant”), her former employer, discriminated against her on the basis of race, color, gender and marital status in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. §2000e-5 and the New York Executive Law §291. Presently before the Court is a motion by the defendant to dismiss the amended complaint for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1) or, in the alternative, for failure to state a claim upon which relief can be granted pursuant to Federal Rule of Civil Procedure 12(b)(6).
