ALLSTATE INSURANCE CO. v. BRUCE REZNICK, P.C. Plaintiff moves, pursuant to CPLR §3212, for an order granting summary judgment in its favor against defendant Shirley Brill (hereinafter Brill) on the ground that Brill prejudiced plaintiffs subrogation rights by executing general releases in breach of plaintiffs insurance contract. Plaintiff further moves for summary judgment against defendant Bruce Reznick P.C. (hereinafter Reznick) on the ground that Reznick tortiously interfered with plaintiffs subrogation rights by providing advice and consent to Brills execution of the general releases. Defendants cross-move for summary judgment dismissing the complaint on the grounds that plaintiffs subrogation rights are still in force; plaintiff consented to the conditional releases; and upon the doctrines of waiver, estoppel and laches.
