PEOPLE v. PAUL RIVERS, JR. — By Indictment No. 02-1056-01, defendant is charged with a single count of Robbery in the first degree, in violation of Penal Law §160.15(3), a single count of Robbery in the first degree, in violation of Penal Law §160.15(4), a single count of Criminal Use of a Firearm in the first degree, in violation of Penal Law §265.09(1)(b), a single count of Robbery in the second degree, in violation of Penal Law §160.10(1), a single count of Assault in the second degree, in violation of Penal Law §120.05(2), two counts of Criminal Possession of a Weapon in the third degree, in violation of Penal Law §265.02(1), a single count of Grand Larceny in the fourth degree, in violation of Penal Law §155.30(5), a single count of Menacing in the second degree, in violation of Penal Law §120.14(1), and a single count of Criminal Possession of Stolen Property in the fifth degree, in violation of Penal Law §165.40. On October 9, 2002, the defendant was arraigned on the instant indictment in the presence of counsel and entered a plea of not guilty to all counts charged therein. By omnibus motion, defendant seeks various forms of relief which this Court will address in seriatim:
