ALBANY - A woman appealing her decade-old conviction for the depraved indifference murder of her child is subject to state Court of Appeals’ jurisprudence on depraved mind homicide as it now exists and not at the time of the trial, an upstate appellate panel has held.
The Appellate Division, Third Department, agreed that Brenda J. Snyder’s conviction should stand, but split 3-2 on which view of depraved mind murder applies and whether the high court’s seminal holding in People v. Feingold, 7 NY3d 288 (2006), is retroactive.
