The landlord of Mount Sinai Hospital on Manhattan’s Upper East Side cannot collect 12 years worth of unpaid property operating expenses amounting to nearly $380,000 because it did not send the hospital regular bills, as required by the hospital’s lease, a Manhattan Commercial Division judge has ruled.

Justice Eileen Bransten (See Profile) found in The Mount Sinai Hospital v. The 1998 Alexander Karten Annuity Trust, 652035/11, that the landlord, The 1998 Alexander Karten Annuity Trust, could bill the hospital for only the last two years of the 12-year period.
