The U.S. government’s bid to have the Second Circuit rehear en banc a decision barring the conditioning of taxpayer-funded grants to prevent AIDS/HIV on a pledge not to encourage prostitution has been shot down.

A majority of the active judges on the Second Circuit voted to deny rehearing en banc in Alliance for Open Society International v. US Agency for International Development, 08-4917-cv.
