ALBANY - Real estate buyers must prove they are “ready, willing and able” to close the deal when they come to the table to complete a transaction in order to bring damage claims against sellers who repudiate a sales contract, the state’s highest court ruled on Feb. 9.

A unanimous Court of Appeals noted in Pesa v. Yoma Development Group Inc., 3, that the question of whether a buyer is ready to conclude a deal had split several Appellate Division panels.
