A doctor who performed a caesarian section that ended in a stillbirth will not face a medical malpractice lawsuit for going ahead with the procedure after the baby’s heartbeat appeared to stop, an Appellate Division, First Department, panel has ruled.
In a March 1 opinion in De Jesus v. Mishra, 25804/04, the panel found that the mother, Katherine De Jesus, had not alleged enough facts to support her claim against the physician who ordered the c-section, Aruna Mishra of the Bronx-Lebanon Hospital Center.
