ALBANY - A bill that would bar medical malpractice defendants from conducting ex parte interviews with a plaintiff’s nonparty treating physicians has sailed through the state Senate Judiciary Committee.

The measure, A694/S3296, would restore Article 31 of the Civil Practice Law and Rules as the statute governing discovery in civil matters and undo the Court of Appeals’ 2007 ruling in Arons v. Jutkowitz, 9 NY3d 393, according to Senator John Bonacic, chairman of the Judiciary Committee.
