A sweeping remedial order by Eastern District Judge Nicholas Garaufis (See Profile) requiring New York State to develop thousands of residences for mentally ill adults has been upset by a federal appellate court.
The U.S. Court of Appeals for the Second Circuit on April 6 ruled that the nonprofit legal services group Disability Advocates Inc., which sued the state in 2003 under the Americans with Disabilities Act and the Rehabilitation Act for failing to provide supported housing, had no standing to sue in the case.
