In this pending proceeding, the decedent, Lloyd Bacchus, died intestate on September 9, 2009, a resident of Richmond County. This is an application brought by Raquel Alagracia Reyes de Bacchus, decedent’s surviving spouse and second wife, hereinafter referred to as the "Petitioner,” to extend Petitioner’s time to file a Notice of her Right of Election.

A petition for Letters of Administration was filed in this Court on April 30, 2010 by Joycelyn E. Bacchus, one of the decedent’s four children. That petition named only four adult children as distributees of the decedent, and made no mention of a surviving spouse. The four children are not the children of the Petitioner and allege to have been unaware of the marriage between their father to the Petitioner. As a result of the verified petition for Letters of Administration, full Letters were issued to Joycelyn E. Bacchus, hereinafter referred to as the "Administratrix,” on May 4, 2010.
