Campbell appealed from an order granting attorney Carrozzo summary judgment dismissing a legal malpractice complaint against him. Campbell signed a contract to buy a house from a broker at Planet Asef Realty (PAR) in “as is” condition without consulting an attorney. Carrozzo was asked to represent Campbell at the closing by a PAR representative. He extended Campbell’s time to have the premises inspected and the seller’s guaranties. After closing, Campbell failed to inspect the house in the time required, and upon inspection learned it required structural remediation. She sought damages from Carrozzo for his alleged malpractice and fraud. The court granted Carrozzo dismissal, and this panel unanimously affirmed, finding Campbell was already into contract for the purchase at the time she met Carrozzo, and before he performed any legal services for her. It found she failed to perform due diligence of the property’s condition before signing the contract and was bound by it despite the structural deficiencies she later discovered. The panel ruled Campbell failed to prove any breach of duty by Carrozzo caused her alleged damages, concluding summary judgment dismissing the claims against him was properly awarded to Carrozzo.
