In this proceeding to judicially settle the account of the Public Administrator, objections were filed by an alleged nephew, niece and three grand nephews who originally alleged that they were the decedent’s only distributees as they were unable to locate another niece, Susan Carol Barron (nee Berman). A kinship hearing was held before the court at which the guardian ad litem for unknown heirs, the Public Administrator and the Office of the Attorney General participated.

The proof at trial consisted of documents, including probate and accounting filings for the decedent’s father, and the testimony of three witnesses; namely, a genealogist, the wife of the alleged surviving nephew and the mother of the three alleged grandnephews. At the conclusion of the hearing, the record was left open until a date certain to enable the objectants’ genealogist to submit additional research with respect to the alleged niece Susan Barron, whose whereabouts were then unknown. That additional research located Susan Barron, and the guardian ad litem filed a third report recommending, inter alia, that she be included as a distributee. The time to submit any replies or opposition is now expired.
