ALBANY - A deeply splintered Court of Appeals yesterday held that a plea bargain conditioned on withdrawal of a speedy trial motion is valid if the condition is set by the judge rather than the prosecutor.
People v. Alexander, 80, represents the latest take on an issue the high court has addressed several times in different contexts: whether a defendant can be required to forfeit speedy trial rights in order to take advantage of a plea offer.
