ALBANY - Evidence that a man abused his wife was properly admitted to show implicit forcible compulsion in a case where the defendant was accused of raping his wife’s 15-year-old niece, an upstate appellate panel has held.
The Appellate Division, Third Department, said that Mark Blond’s abusive behavior toward his wife was relevant to the rape prosecution and provided probative context to the teenager’s “fear of defendant and resulting unwillingness to tell anyone about the sexual abuse until after he was in police custody as a result of his most recent altercation with his wife.”
