Two appellate justices voiced support on June 22 for a key argument mounted by Queens District Attorney Richard A. Brown in his effort to block Justice Joel L. Blumenfeld’s order finding unethical the routine practice of interviewing suspects shortly before they are arraigned.

Acting Presiding Justice William F. Mastro (See Profile) and Justice Peter B. Skelos (See Profile) expressed concern during oral argument before the Appellate Division, Second Department, that Blumenfeld had framed his April 17 ruling as an ethical violation, rather than suppressing a defendant’s statement outright, in a maneuver to unfairly deprive the district attorney’s office of its right to appellate review.
