A Nassau County lawmaker has withdrawn his appeal and paid a federal judge’s $2,500 sanction for contempt of court. Peter Schmitt, presiding officer of the Nassau County Legislature, was sanctioned by Eastern District Judge Arthur Spatt in June for revealing portions of a confidential police report during a brief interview with a reporter.

The report was issued following the 2009 murder of Jo’Anna Bird by her ex-boyfriend. Schmitt’s interview occurred in February, just as the Legislature was approving the $7.7 million settlement of the civil rights action filed by her estate against the county. Schmitt initially pledged to appeal Spatt’s order and to seek a modification of the judge’s December 2011 confidentiality order on which it was based.
