Two Queens prosecutors are protected by absolute prosecutorial immunity from suit in a case alleging they improperly interrogated a woman about her suspected assault at the hands of former State Senator Hiram Monserrate in 2008, the U.S. Court of Appeals for the Second Circuit has ruled.
Karla Giraldo sued Queens Bureau Chief of Domestic Violence Scott Evan Kessler and Assistant District Attorney Keshia Espinal for their extended interrogation as Giraldo continued to claim she was injured when Monserrate brought her a glass of water that accidently shattered, causing a cut to her forehead.
