With the Supreme Court beginning its 2012 term next week, we conduct our 28th annual review of the performance of the U.S. Court of Appeals for the Second Circuit over the past term, and briefly discuss the Second Circuit decisions scheduled for review during the upcoming term.

During its 2011 term, the Supreme Court handed down merits opinions reviewing decisions by the U.S. Courts of Appeals in 63 cases, including seven summary reversals. The performance of the circuit courts is described in the accompanying chart, with the Supreme Court affirming (in whole or in part) 25 decisions (or 40 percent) and reversing 38 (or 60 percent) of these 63 cases.
