ESTATE OF CHIARA RAPPA, Deceased (444A/09) — By ex parte application, Anna Maria Rappa (Anna Maria) and Lucia Houtas (Lucia, and together with Anna Maria, the petitioners), as co-administrators of the estate of Chiara Rappa (the decedent), seek an order i) confirming the confidentiality condition of a Release and Stipulation to Dismiss (the release) and ii) sealing the records of the Surrogate’s Court relating to the instant estate, including any application for leave to compromise the cause of action for wrongful death of the decedent and for leave to distribute any proceeds thereof.

The decedent died, intestate, on January 16, 2007, survived by her mother and sister, the petitioners herein, and by her biological father. Limited letters of administration were issued to the petitioners on January 19, 2012. The petitioners have instituted a cause of action for the wrongful death of the decedent (the wrongful death action) against certain defendants, which cause of action relates to the decedent’s ingestion of an anti-depressant medication.
