A magistrate judge in Buffalo has ordered oral argument on whether the latest attorney seeking to withdraw from Ceglia v. Zuckerberg—a high-profile dispute over Facebook profits—can step down. Western District Magistrate Judge Leslie Foschio (See Profile) also declined to strike evidence suggesting that the plaintiff forged a purported contract with Facebook founder Mark Zuckerberg.

Foscio’s Oct. 30 order on the attorney withdrawal motion, and Oct. 31 decision on alleged forgery evidence, follow the unsealing in the Southern District a few days before of a criminal complaint accusing Paul Ceglia of attempting to defraud Zuckerberg and his company.
