2010-3688/B ESTATE OF MILLY ROSEN, Deceased — At the call of the calendar on January 31, 2012, the court granted the petition of DK Towers Apartments LLC to compel the fiduciary of the estate of Milly Rosen to account, pursuant to SCPA 1307, subject to petitioner’s filing proof of service of the citation on respondent Albert Rosen.

Despite representations of counsel that an affidavit of service would be filed, to date there has been no such filing. More than a reasonable period of time having elapsed, the petition is denied, without prejudice.
