ESTATE OF ARTHUR GOLDKNOPF, Deceased — In this proceeding to judicially settle the account of the Public Administrator, a kinship hearing was held before a member of the court’s Law Department designated to hear and report, upon the consent of all parties. More than 10 days have elapsed since the mailing of the referee’s report, and no party has moved to modify or overrule the report.

After review by the court, the findings of fact and conclusions of law set forth in the report are confirmed, including that the decedent was survived by three maternal first cousins, namely, Harriet Myra Hackman, Howard Martin Nadler and Bruce Nadler, each of whom is entitled to one-third of the maternal half of the estate or one-sixth of the entire net distributable estate. The decedent was also survived by five paternal first cousins, namely, David Goldknopf, Jay Michael Garrett, David Meyer Fishkin, Dorothy H. Basman, who post-deceased, and Laura Geraldine Webber, each of whom is entitled to one-fifth of the maternal half of the estate or one-tenth of the entire net distributable estate (EPTL 4-1.1 [a] [6]). The share of the post-deceased distributee shall be paid to the duly appointed fiduciary of her estate. If no fiduciary is appointed for the postdeceased distributee within 60 days of the entry of the decree to be settled hereon, the share for that distributee shall be paid to the Commissioner of Finance of the City of New York for the benefit of that distributee’s estate or any person who may prove their entitlement thereto.
