Kissel, an infant, requests that the court amend its decree dated February 21, 2006, which appointed her as property guardian and directed that the infant's funds be deposited with Merrill Lynch under joint control with the court. Petitioner requests a change of depository from Merrill Lynch to LPL Financial LLC, and further requests that she be authorized to enter into an Investment Advisory Agreement with LPL Financial LLC ("the "Agreement"), which has been submitted for the court's review. The court has reviewed the proposed Agreement, which consists of the Account Application, the Strategic Asset Management (SAM) Account Agreement, and the Guardianship Supplement, and, as revised, finds it “acceptable” within the meaning of the applicable statute (SCPA 1708[c][2]). LPL Financial LLP will invest and manage the infant’s funds in accordance with the Prudent Investor Act (EPTL 11-2.3); discloses its annual fee and agrees not to raise its annual compensation without order of this court; agrees not to release funds without such order; and has submitted to the jurisdiction of this court for all disputes regarding the Agreement. The Agreement is thus approved (SCPA 1708 [2] [c]).
