ESTATE OF CARMELEAU HYPPOLITE, Deceased (2008-1291-A/B/C) — During life, decedent Carmeleau Hyppolite was a member of a class of workers who sought back pay and other relief for racial and national origin discrimination in an action in Federal District Court for the Southern District of New York. His spouse as administrator continued in his stead as a claimant in this class action after his death. The action settled pursuant to an order of the Southern District Federal Court, the procedures established under which determined that decedent’s gross share of the settlement was $16,928.53. Taxes having been withheld from that gross award, the net amount coming into the estate is $15,632.01. Although the petition here seeks to compromise the action, that determination has been made by the Southern District Federal Court (see EPTL §5-4.6[a]). Counsel in that proceeding worked on a pro bono basis, and thus, no fees or costs of counsel in the class action are sought herein.

Counsel to the administrator in this proceeding seeks fees and disbursements, and they are fixed and determined as requested in the petition. The administrator waives commissions, and no reimbursement is sought for decedent’s funeral expenses.
