A citizen of Serbia who was attacked and threatened for meeting with international officials investigating war crimes in Kosovo was wrongly denied asylum in the United States by immigration courts that applied the wrong standard, a federal appellate court has ruled.

Azem Gashi will get a second chance to stay in the United States because the United States Court of Appeals said an immigration judge erred by finding Gashi was not part of a “particular social group” meriting protection within the meaning of the Immigration and Nationality Act.
