ESTATE OF EVA TAYLOR, ALSO KNOWN AS EVA MAE TAYLOR, Deceased — In this proceeding to judicially settle the account of the Public Administrator, objections were filed by an alleged nephew who alleges that numerous siblings, nephews/ nieces or grand nephews/nieces are the decedent’s only distributees. The kinship issues were referred to a member of the court’s Law Department to hear and report (see SCPA 506 [1]). More than 10 days have elapsed since the mailing of the referee’s report, and no party has moved to modify or overrule the report.

After review by the court, the findings of fact and conclusions of law set forth in the report are confirmed, including that the decedent’s distributees are: (1) her three siblings Henrietta Lumpkin who post-deceased the decedent on November 8, 2004, Fannie Marie Mcdaniel who post-deceased the decedent on April 19, 2006 and George Mcdaniel who post deceased the decedent on October 24, 2004; (2) her three nieces/nephew who are the children of her predeceased sister Mildred Florence Williams, namely, Joyce Ann Williams Lowinger, Norma Jean Williams and Robert Eugene Williams; and, (3) her eight grand nieces/ grand nephews who are the grandchildren of her predeceased sister Marty Gertrude Mcdaniel and predeceased brother William Webster Mcdaniel, namely, Virginia Ann Lyons who postdeceased the decedent, Henry Gene Crumpler, Mazie Crumpler, James Oliver Crumpler, Leon H. Crumpler, John Frederick Crumpler, Hilda Grace Crumpler and Steven Debois Exum, the last of whom also post-deceased the decedent.
