ESTATE OF VERA LAWRENCE THORNE, Deceased (2004/2006/B) — In this miscellaneous proceeding, Jayne M. Dennis, Esq. (the petitioner) seeks a determination pursuant to SCPA §2110, of legal fees, costs and disbursements incurred in connection with her representation on behalf of the executor in the instant estate since her retention in 2004 through February 2012. The executor objects to the attorney’s fees requested. The parties have consented to these issues being decided by the Court based on their submissions.

Decedent died testate on November 2, 2003, with a last will and testament dated July 10, 1993. The will was probated and letters issued to the executor on September 15, 2004. The decedent’s estate primarily consisted of real property located at 190 Lincoln Road, Brooklyn, New York, which was specifically devised to decedent’s three daughters. One of the daughters, Yvonne, predeceased the decedent and pursuant to decedent’s will her share was to be divided among six of decedent’s grandchildren. In addition, in her will the decedent reserved a life estate in this property for her grandson, Isa Muhammad (“Isa”). At the time of decedent’s death, Isa was residing in the property. While Isa continued to live at the subject property it fell into disrepair and the mortgage thereon went into foreclosure. In addition, taxes, water and gases were not paid. This property became the subject of vigorous litigation.
