MATTER OF THE GUARDIANSHIP OF Brittany M. B., (209G/01) — A decree of this court entered December 4, 2001 granted letters of guardianship of the property of the infant to her mother. The infant was to receive funds due to the death of her father in the 2001 World Trade Center tragedy, and pursuant to this court’s authorization, monies were deposited into various banks. Since that time there have been certain authorized withdrawals and the last annual account was filed in 2010 for the year ending 2008. The infant and the guardian no longer reside in New York State. Despite requests from court personnel, the guardian has failed to file further annual accounts. Moreover, it has now come to the court’s attention that there may have been unauthorized withdrawals concerning accounts at Banco Popular and Wells Fargo.

Under these circumstances the court, sua sponte, to protect the infant’s assets suspends the letters of guardianship of the property that issued to the guardian and appoints Stonley Parress Esq., as guardian ad litem for the infant (see SCPA 711 [2],[8]; SCPA 719 [10]). The guardian ad litem is authorized to take any appropriate action including, but not limited to, instituting proceedings to revoke the mother’s letters of guardianship of the property and commencing any actions or proceedings to recover any funds on behalf of the infant.
