9347. PEOPLE, res, v. NAIQUAN WALTERS, def-ap — Office of Appellate Defender, New York (Richard M. Greenberg of counsel), for ap — Cyrus R. Vance, Jr., District Attorney, New York (Ellen Stanfield Friedman of counsel), for res — Judgment, Supreme Court, New York County (Edward J. McLaughlin, J.), rendered January 12, 2011, as amended April 26 and April 28, 2011, convicting defendant, after a jury trial, of criminal possession of a controlled substance in the fifth degree, and sentencing him, as a second felony drug offender, to a term of 3 years, unanimously affirmed.

Defendant’s arguments concerning evidence of uncharged crimes are entirely unpreserved, and we decline to review them in the interest of justice. As an alternative holding, we reject them on the merits. The probative value of this evidence outweighed its prejudicial effect.
