Erie County’s attempt to force an airline to pay clean-up costs associated with a plane crash has been rejected by a unanimous panel of the U.S. Circuit Court for the Second Circuit.
The county had claimed that the bodies of those killed created a public health hazard and nuisance sufficient to overcome the free public service doctrine.
