Syracuse University’s insurer is obligated to cover the school’s costs of complying with six subpoenas prosecutors issued during criminal investigations of child molestation against ex-Syracuse basketball coach Bernie Fine, a state judge has ruled.
Supreme Court Justice Donald Greenwood in Onondaga County (See Profile) held that the National Union Fire Insurance Co.’s duty is "clear and unambiguous" under its policy, and he ordered the New York City-based insurer to comply with the policy’s provision that it cover the school’s costs of defending against the subpoenas in excess of $250,000.
