A state appeals panel has thrown out a $2 million jury verdict awarded to a Bronx man who was strapped to a chair and Tasered by police who were trying to take him to the hospital because he had suffered a seizure.
A unanimous panel of the Appellate Division, First Department, ruled on March 21 in Pacheco v. City of New York, 16368/07, that the police were justified in using the Taser because the man, Carlos Pacheco, was emotionally disturbed and violent.
