ESTATE OF CHARLOTTE TAYLOR, a/k/a CHARLOTTE S. TAYLOR, Deceased (2129 P 2006/H) — Movant, a son of decedent who is a residuary beneficiary of one-third of decedent's estate and an objectant in the underlying accounting proceeding, requests that "the Court grant Objectant's motion for summary judgment and to conform the pleadings to the proof." The Notice of Motion in this matter contained a similar request "for an Order granting partial summary judgment in his [movant's] favor, pursuant to Rule 3212 of the New York Civil Practice Law and Rules, and granting leave to conform the pleadings herein with the proof." As movant's memorandum of law, which was apparently served on notice with the motion papers, contains a more specific request for relief, it will be filed with this decision. As this motion is unopposed, the court will liberally construe movant's pleadings to ascertain, from a reading of the "Answer and Objections" filed in the underlying accounting proceeding and the "Affirmation in Support of Motion for Summary Judgment" as a whole, which portions of movant's objections may be sustained based on the record presently before the court.
