ESTATE OF BETTIE MACKEY, ALSO KNOWN A BETTIE L. BROWN MACKEY, Deceased (327/13) — On the return date of this application by an alleged creditor for the issuance of letters of administration to the Public Administrator, there was no appearance by the decedent's grandson and alleged sole distributee, and the Public Administrator consented to the issuance of letters. However, counsel for the creditor stated on the record that the grandson informed him that he is in possession of an alleged testamentary instrument and intends to petition for letters testamentary. Based upon this representation, if the grandson fails to take all of the necessary steps to be appointed the fiduciary of the decedent's estate by May 20, 2013, letters of administration shall issue to the Public Administrator upon duly qualifying under the law.
