ESTATE OF BEATRICE SCHUMAN, Deceased (3774/A/08) — A referee appointed to supervise discovery in a contested probate proceeding is seeking compensation for her services.

In a decision dated June 20, 2010, this court appointed Barbara Levitan, Esq., as referee to preside over discovery in the estate of Beatrice Schuman, pursuant to SCPA 506(1), and directed that the “amount and allocation of the referee’s compensation and expenses shall be fixed by the Court in its discretion upon the filing of an affidavit of services by the referee at the conclusion of these proceedings.” After extensive litigation, the probate proceeding has been determined by a decision on a motion for summary judgment in favor of the will proponent (Matter of Schuman, NYLJ, Jan. 8, 2013 at 22, vol 6 [Sur Ct, NY County 2013]) and letters testamentary have issued accordingly.
