ESTATE OF LINDA BROWN, Deceased (2403A/10) — This is a proceeding by Stanley Brown (the petitioner), as administrator of the estate of Linda Brown (the decedent), for leave to compromise and settle a cause of action for personal injury of the decedent (the cause of action). The instant petition, as amended, includes an application for an order of this court confirming the confidentiality of the terms of settlement and distribution, and sealing any and all records of this court relating to the instant estate, including i) the petition seeking approval of the terns of settlement, as well as distribution and apportionment the proceeds thereof, ii) the decree approving such settlement and distribution, iii) the application for an order of this court sealing the records herein, and iv) the order granting confidentiality.

The court first addresses the petitioner’s request that all records pertaining to the instant application be sealed. The petitioner asserts in the instant application that a Master Settlement Agreement (the settlement) of the cause of action instituted by the decedent has been reached. The petitioner asserts that a condition of the settlement agreement is execution of a Confidential Release of All Claims (the release), which prohibits disclosure both of the terms of the settlement and of the details of any petition for leave to settle and compromise the cause of action. The petitioner seeks an order sealing the record of the instant estate, asserting that such action is necessary to effectuate the settlement, and that the confidentiality provisions of the release are “a vital component” of the settlement.
