With the nomination by Governor Andrew M. Cuomo of Justice Sheila Abdus-Salaam, the court is one short step away from having a full bench. Confirmation by the New York State Senate, the one remaining step in the process, appears assured. Abdus-Salaam’s nomination in our view will be well-received by bench and bar. Subject to action by the Senate, the court’s newest judge could join the court for arguments as early as next month.
We also note in this issue the first majority opinion for the court by Judge Jenny Rivera in People v. Griffin, the first of what will be many. We also discuss Overstock.com and Amazon.com v. New York State Department of Taxation and Finance, companion cases upholding the constitutionality of a section of the tax law relating to the collection of sales tax on Internet purchases. Also discussed is White v. Farrell in which the court decided the measure of a seller’s damage for a buyer’s breach of contract to buy real property.
