ESTATE OF FRANCES GECKS, Deceased (A-130/94/D) — In this SCPA 2225 proceeding, Petitioner seeks to obtain funds currently being held in escrow by the Public Administrator of Richmond County for the benefit of paternal heirs. These funds are being held in escrow as part of the judicial account of the Public Administrator. At that time, the Public Administrator's account indicated that there were maternal distributees, but failed to preclude the existence of other distributees who might be entitled to either priority or to share equally in the distribution of the estate.

ESTATE OF FRANCES GECKS, Deceased (A-130/94/D) — In this SCPA 2225 proceeding, Petitioner seeks to obtain funds currently being held in escrow by the Public Administrator of Richmond County for the benefit of paternal heirs. These funds are being held in escrow as part of the judicial account of the Public Administrator. At that time, the Public Administrator’s account indicated that there were maternal distributees, but failed to preclude the existence of other distributees who might be entitled to either priority or to share equally in the distribution of the estate.

Decedent died on October 22, 1993. On the proof submitted and upon the recommendation of the Guardian ad Litem, and jurisdiction having been obtained over all necessary parties, including the Office of the Attorney General of the State of New York, the Court is satisfied that the requirements of SCPA 2225 have been met and that despite diligent and exhaustive efforts, no information can be adduced that would indicate the existence of distributees in a closer or equal relationship to decedent than those maternal distributees, as indicated within the petition.
