A judge has upheld contribution limits for citywide candidates who do not accept public matching funds. Acting Manhattan Supreme Court Justice Kathryn Freed ruled in McDonald v. New York City Campaign Finance Board, 100038/2013, that local laws enacted by New York City in 2004 and 2007 extend the contribution limits to candidates who don’t accept public money.

State Election Law sets campaign contribution limits for the mayor at $19,700 for a primary and $41,000 for a general election. However, state law does not address the legality of a locality like New York City establishing a public campaign financing system, or the establishment of lower campaign limits than the state allows. New York City limits contributions for mayor to $4,950 per person.
